Eric Bischoff, Jason Hervey and Bischoff’s son Garrett have filed a lawsuit against TNA Wrestling for breach of contract, according to a report from ProWrestling.Net who note that the suit was filed on May 15th in Davidson County Tennessee and that TNA Wrestling owes them $114,500.02.

According to the report, Eric Bischoff and Hervey (listed under their production company that they co-own) allege that they were hired by TNA Wrestling on a “pay or play deal and that the two, along with Garrett state that the company made payments to them until the end of September and that BHE (Bischoff-Hervey Entertainment) notified TNA Wrestling of a breach of contract on November 4th due to a failure to pay their October payment, while a second notice was issued on November 24th, which led to TNA Wrestling eventually paying the three men $101,500 at some point before January 1st, 2015, however BHE and Garrett are seeking the same amount for the final 3 months of their contract which expired on March 31st, 2015. The report also states that Garrett Bischoff was part of the first agreement and signed his own seperate contract with TNA Wrestling on October 24th which included $2,166.67 monthly on a pay or play deal, along with $500 for paid performances, however his deal expired in March and he claims that TNA Wrestling still owes him $13,000.02.

TNA Wrestling meanwhile issued a response on January 12th of this year claiming that they had paid Bischoff-Hervey Entertainment in full, a claim that BHE refutes. According to the report, Bischoff-Hervey Entertainment’s attorney Bryan Lewis told TNA Wrestling’s lawyer, “When the money was sent, you did not make it clear whether it was in connection with the settlement offer that was on the table or a reinstatement by TNA. TNA did not make a request that BHE perform services when the money was sent. BHE stands ready, willing and able to perform under the agreement in the event TNA is reinstating that agreement.”
